Booking Terms and Conditions

 

Definitions

The Bundu Bus Tours and Safaris cc CK96/15779/23 T/A The Bundu Safari Company herein after referred to as the “Bundu” and the person or persons who have signed the booking form is herein after referred to as the “Client”.  Upon signature the client agrees to be bound by these booking conditions and any contract between the client and Bundu is subject to and shall be governed and construed according to South African law.

 

The Booking

2.1   A signed and completed booking form must be sent to Bundu or its agent together with a non-refundable deposit of 20% of the tour price.  The balance of the tour fare is to be paid 28 working days prior to the date of departure. 

2.2   Bundu will not accept any booking where the booking form has not been signed or is incomplete.  Once Bundu is in receipt of a signed Booking Form, plus 20% deposit, a confirmation will be issued.  It is only at this time the booking will be deemed for acceptance.  Bundu reserves the right to decline any booking.

2.3   All tour prices and services are correct at the time of printing and Bundu reserves the right to change all prices, services and departures without prior notice.  However once a booking has been made and the full tour cost paid, Bundu will not increase the price. 

 

Language

All tours are conducted in English.

 

Travel Insurance

4.1   Comprehensive travel insurance covering cancellation, curtailment, medical, emergency travel and personal accident is compulsory on all tours.  Insurance for loss of baggage, money or personal items is recommended. 

4.2   The client accepts that it is his/her responsibility to arrange insurance.

 

5.      Full payment of tour cost

Full payment of the tour cost is due 28 working days prior to departure.  If full payment is not received by this time Bundu may treat the booking as cancelled.  Any bookings made within four weeks of departure must be accompanied by full payment of the tour cost. 

 

6.      Local Payment

The local payment is to be paid to the guide on the day of departure in US$ cash only.  No traveller’s cheques or other currencies will be accepted.  

 

Cancellation or changes to Bookings

7.1   Cancellation of any booking must be received in writing and acknowledged by Bundu.

7.2   In the event of cancellation the following cancellation fees will be payable by the client:

·         Notification is received 28 days or more before departure, loss of 20% deposit.

·         28 -21 working days, loss of 50% of tour cost

·         20 -14 working days, loss of 80% of tour cost

·         13 - 0 working days, loss of 100% of tour cost

·         If you fail to join a tour, join it after it’s departure, or leave it prior to its completion for any reason, no reimbursement whatsoever will be made.

 

7.3   Changes made by you: If you need to change your reservation for whatever reason, 

Bundu will make every effort to assist you.  You may move your reservation to another date, subject to availability and agreement with our reservation office.  Any changes will incur a fee of US$ 50 and any subsequent cancellation fee will be based on date of original travelling date.  Should we not be able to help you with alternative dates, the normal cancellation fees will apply.

7.4   Bundu reserves the right to change or cancel any tour although every effort will be made to operate itineraries as advertised.  

7.5   In the event of tour being cancelled, the client may choose a full refund or alternatively any other tour that Bundu is in position to offer.  If the price of the alternative tour is less than the original tour booked, the difference will be refunded to the client.  If the alternative tour is more expensive, then the client will be liable for the additional cost. 

 

 

8.      Passport, visas and other travel documents

8.1 The client is responsible for ensuring that all documents, passport, visas and health certificates are valid.

8.2 The client accepts full responsibility for obtaining all the relevant travel documents required. 

8.3 Should a client be refused entry to any country due to incorrect documentation, Bundu will not be liable for any costs of such delays or repatriation cost for the client. 

 

9.       Baggage  

9.1 All personal effects and baggage are at all times the clients responsibility and Bundu will not accept liability for any loss or damage to baggage or personal effect. 

9.2 Clients are entitled to one bag of not more than 15 kg and a small daypack.  Bundu reserves the right to refuse excess luggage.  NO SUITCASES PLEASE.

 

10.  Health

10.1 It is the responsibility of the client to consult a health professional with respect to        recommended and compulsory vaccinations and health pre-cautions.  Any pre-existing medical condition must be declared at the time of booking and the client must make arrangements for the provision of drugs or other treatment that may be required during the tour.

10.2 Clients are aware of the proposed itinerary and that the tour requires a measure of physical fitness and health and that they are medically fit to embark on the tour.

10.3 Anti-malaria precautions are recommended for all tours and clients are advised to bring insect repellent. 

 

11.   Onward Travel Arrangements

11.1 Bundu recommends onward travel arrangements only for the day after the tour ends.

11.2 If the arrangements are made for the same day the tour ends, Bundu cannot be held responsible for any delays resulting in failure to meet those arrangements.  

 

12.  Age Group

12.1 We cater for people aged 18-45 on our tours.

12.2 If you are outside this age group you will need to complete a form stating you understand the nature of the tour and will be accepted on the tour at the discretion of management.

 

13. Force Majeure

Unforeseen circumstances including weather, road conditions, war, mechanical breakdowns, riots and other reasons beyond the control of Bundu may cause delays or alterations to the tour.   In the event of any of the aforementioned occurring, Bundu shall not be held liable in any way for any resulting costs of these delays or alterations.

 

14. Exclusion of Liability

14.1 Clients bookings are accepted on the understanding by the client that all tours are of an adventurous nature and involve an element of personal risk that is an inherent part of travel in Africa.

14.2 Clients undertake all tours entirely at their own risk and while Bundu take every precaution to ensure the safety of the clients, no responsibility can be accepted for any death, injury or loss that might occur to such clients, sustained from any cause what so ever. 

14.3 The client and his/her dependants, heirs, executors, administrators or assigns, hereby indemnify and hold blameless, Bundu, it’s members employees, representatives and agents from any claims of whatsoever nature and from any liability for delay, loss, damage, injury, illness or death arising from any cause whatsoever out of events related to or occurring during a tour. 

14.4 The client agrees to strictly abide by the laws and regulations of each country we visit.  

14.5 Clients are responsible for checking in on time and are responsible for reconfirming flight times.  Bundu cannot be responsible for delays caused by airline flight alterations, cancellations or delays.

14.6 When you book excursions not operated by Bundu (whether recommended by the company or not), Bundu will have no legal liability for problems arising from the excursion and any claim will be against the relevant local operator (e.g. white water rafting, bungee jumping, Delta etc) 

 

 

 

 

15. Photography

Bundu reserves the right to make use, without giving any further notice, of any photograph or film produced by Bundu without payment or permission.

 

16. Complaints

If the client has a complaint whilst being on tour they must bring it to the guides attention so that it can be dealt with.  If the matter isn’t resolved whilst on tour, the clients must write to Bundu within 30 days of completion of the tour.  Bundu will not entertain complaints of loss of enjoyment where full land arrangements have been provided.  

 

 

17. Use of Site

You may only use this site to browse the content, make legitimate purchases and shall not use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent purchase. This site and the content provided in this site may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed. Deep-linking', 'embedding' or using analogous technology is strictly prohibited. Unauthorized use of this site and/or the materials contained on this site may violate applicable copyright, trademark or other intellectual property laws or other laws.

 

18. Disclaimer of warranty

The contents of this site are provided "as is" without warranty of any kind, either expressed or implied, including but not limited to warranties of merchantability, fitness for a purpose and non-infringement.

The owner of this site, the authors of these contents and in general anybody connected to this site in any way, from now on collectively called "Providers", assume no responsibility for errors or omissions in these contents.

The Providers further do not warrant, guarantee or make any representation regarding the safety, reliability, accuracy, correctness or completeness of these contents. The Providers shall not be liable for any direct, indirect, general, special, incidental or consequential damages (including -without limitation- data loss, lost revenues and lost profit) which may result from the inability to use or the correct or incorrect use, abuse, or misuse of these contents, even if the Providers have been informed of the possibilities of such damages. The Providers cannot assume any obligation or responsibility.

The use of these contents is forbidden in those places where the law does not allow this disclaimer to take full effect.

 

19. Your Rights

We reserve the right to:

1. modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
2. change these Conditions from time to time, and your continued use of the Website (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.
3. We will use our reasonable endeavours to maintain the Website. The Website is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website due to circumstances beyond our control.

 

20. Privacy policy

We are committed to protecting your privacy. This privacy policy applies to all the web pages related to this website.

All the information gathered in the online forms on the website is used to personally identify users that subscribe to this service. The information will not be used for anything other that which is stated in the Terms & Conditions of use for this service. None of the information will be sold or made available to anyone.

22. Security Policy

Virtual Card Services process all credit card transactions. All credit card transactions are 128 bit Secure Socket Layers (SSL) encrypted. The company registration documents and the site's registered domain name are checked and verified by Thawte, ensuring the cardholder and merchant that nobody can impersonate VCS to obtain confidential information.

Virtual Card Services is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. Virtual Card Services Internet servers are protected by firewalls and intrusion detection systems. The Merchant does not have access to credit details. Virtual Card Services continually reviews and enhances its security in line with technological changes.

 

23. Monitoring

We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Website).

 

24. Law

The Conditions will be exclusively governed by and construed in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.
